Last Week Success Story – Appeal for Permanent Residence as a Federal Skilled Worker

The initial application for permanent residence as a Federal Skilled Worker was rejected. This was appealed to the Federal Court and case was heard in Toronto, ON. The Applicant’s application was decided in the context of a wide-scale suspicion of fraud. However, there was no fraud established. Robert Gertler argued that the decision was unreasonable because of unfair and unfounded suspicion be the officer in rejecting the application.

After the hearing Court’s judgement is that the decision under review is set aside and the matter is referred back for redetermination by a different decision-maker.
