Last Week Success Story: The Removal of a Young Family was Stopped
Mr. Gertler recently worked on a Stay Motion trying to stop the removal of a young family. They has lived in Canada for over 6 years.
Young family had submitted a humanitarian and compassionate application which was still pending. Although a deferral request was submitted to Canada Border Services in order to try and stop their removal. But the deferral officer, as expected refused to defer their removal. The refusal to defer was appealed to the Federal Court, along with the submission of a Stay Motion. Finally with a thorough argument based on the irreparable harm of this family, their strong ties to Canada, along with the underlying humanitarian and compassionate application, the removal of a family was stayed. They are permitted to stay and live in Canada.
